1. Acceptance of Terms

By downloading, installing, or using Keepoint ("the App"), you agree to these Terms of Service. If you disagree with any part of these terms, please don't use our App.

2. License to Use

Keepoint is licensed under the GNU General Public License v3.0. This means:

• You can use the App for free, forever
• You can modify the source code
• You can distribute your modifications
• Any modifications must also be open source under GPLv3

3. Your Data, Your Responsibility

Since all data is stored locally on your device:

• You are responsible for backing up your notes
• We cannot recover lost data
• Device loss means data loss unless you export backups
• We recommend regular exports of important notes

4. Acceptable Use

You agree to use Keepoint only for lawful purposes. You will not:

• Use the App for any illegal activities
• Attempt to reverse engineer the App's security features
• Distribute malicious versions of the App
• Violate any applicable laws or regulations

5. No Warranty

Keepoint is provided "as is" without warranty of any kind:

• We don't guarantee uninterrupted service
• We don't guarantee the App will be error-free
• We don't guarantee compatibility with all devices
• Use of the App is at your own risk

6. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Any damages exceeding $0 (the amount you paid for the App)

7. Modifications to the App

We reserve the right to:

• Update the App with new features
• Fix bugs and improve performance
• Change the user interface
• Discontinue the App (with notice when possible)

8. Third-Party Components

Keepoint uses open-source components, including:

• OpenAI Whisper: For voice transcription (MIT License)
• Kotlin Multiplatform: For cross-platform development
• Various open-source libraries: Each with their respective licenses

9. Intellectual Property

The Keepoint name, logo, and original code are protected by copyright. However, as an open-source project under GPLv3, you're free to fork and modify the code according to the license terms.

10. Indemnification

You agree to indemnify and hold harmless the Keepoint developers from any claims, damages, or expenses arising from your use of the App or violation of these terms.

11. Governing Law

These terms are governed by the laws of the jurisdiction where the primary developer resides, without regard to conflict of law principles.

12. Changes to Terms

We may update these terms occasionally. Significant changes will be communicated through the App. Continued use after changes constitutes acceptance of the new terms.

13. Severability

If any provision of these terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms of Service constitute the entire agreement between you and Keepoint regarding the use of the App.
